Terms of sales

I - Object

The general conditions of sale described below detail the rights and obligations of L'Escargote located at: 19 Chemin du Mont Bernard 51000 Châlons en Champagne represented by Mr Denis Machet registered at the Chamber of Commerce of Chalons en Champagne under the No. Siret 379 983 398 000 56 and his client in connection with the sale of the following goods: (crisp , snail bags, persillade). Any service performed by L'Escargote implies the unreserved acceptance of the buyer to these general conditions of sale.

II - Price

The prices of the goods sold are those in force on the day of ordering. They are denominated in euros and calculated without taxes. VAT not applicable, art. 293 B of the CGI As a consequence, they will be increased by the transport costs applicable if it is necessary on the day of the order. L'Escargote has the right to modify its rates at any time. However, it undertakes to invoice the goods ordered at the prices indicated when the order is registered.

III - Discounts and rebates

IV - Discount

No discount will be granted for early payment.

V - Terms of payment

Orders are settled either by: • species; • check • Bank card ; • Paypal; • Transfer Payment is in full before departure of the goods. The order validated by the customer will be considered effective by L'Escargote only when the banking centers concerned have given their agreement. In case of refusal of said centers, the order will be automatically canceled and the customer notified by mail or mail. VI - Retention of title clause

L'Escargote retains ownership of the goods sold until full payment of the price, in principal and accessories. VII - Delivery

The foreign customer outside the European community or overseas department will support local taxation. The delivery time indicated during the registration of the order is given for information only and is not guaranteed. Consequently, any reasonable delay in the delivery of the products can not give rise to the benefit of the buyer to: • the award of damages; • the cancellation of the order. The risk of transport is borne entirely by the buyer. In case of missing or damaged goods during the transport, the buyer will have to formulate all the necessary reserves on the purchase order upon receipt of said goods. In addition, these reservations must be confirmed in writing within 24 hours of delivery by registered letter AR. If the customer wishes to benefit from two delivery locations, he must place two orders with the related shipping costs. If all or part of the delivery addresses are incorrect, the transport costs in force requiring a reshipment by L'Escargote are the sole responsibility of the customer.

VIII - Right of withdrawal

The 14-day withdrawal period does not apply to contracts for the supply of perishable products, such as products sold by escargote.fr The customer can not avail himself of them. However, a cancellation on his part may be taken into account to the extent that the package is in preparation. On the other hand, from the moment the parcel is delivered to the carrier, no cancellation can be taken into account and the payment paid will not be returned.

IX - Claims - litigation

Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in the person who takes the trouble to expose the dispute. Any claim must, to be taken into account, intervene within 24 hours of receipt, given the perishable nature of the products. The package must not have been opened, the products must not be unpacked , returns must be made to my address, in the original packaging . The shipping costs are the responsibility of the customer. X - Force majeure

The responsibility of L'Escargote can not be implemented if the non-execution or the delay in the execution of one of its obligations described in these general conditions of sale arises from a case of absolute necessity. As such, force majeure means any external event, unforeseeable and irresistible within the meaning of article 1148 of the Civil Code.

XI - Competent court

Any dispute relating to the interpretation and execution of these general conditions of sale is subject to French law. In the absence of amicable resolution, the dispute will be brought before the Commercial Court of Chalons en Champagne.

XII - Miscellaneous information
